With this agreement the terms and conditions are set by we for you gmbh in representation of TREND.ME. Under the name TREND.ME we for you gmbh sells designer jewellery with fine gold/silver gold-plated/silver-plated to customers via the website www.trendme.ch. We for you gmbh will hereinafter be referred to as TREND.ME.

we for you gmbh is a limited liability company registered in the St. Gallen Commercial Register under the number CH-160.4.006.033-4. The registered office is Tiefenaustrasse 7 in 8640 Rapperswil SG, CH. The VAT. Number is CHE-394.039.896. E-mail: shop@trendme.ch The acceptance of these General Terms and Conditions of Sale ("GTC") implies the complete and unconditional acceptance of these GTC by the Customer.

All orders placed on the Website are subject to these T&Cs. These are subject to change and update; the terms and conditions applicable to a customer's order for a product are those in force on the date of the order.

1. TOPIC

The GTC exclusively regulate the sale of the products offered on the Website to Buyers who are consumers on the Website and set out the terms and conditions for ordering, payment, delivery and management of returns of the ordered products.

The GTCs are enforceable against the Customer, who declares to have read and accepted them by ticking the box marked I accept the General Conditions of Sale before carrying out the online ordering procedure.

2. CUSTOMERS

The customer of the Website must be a consumer: in, a natural person of full age and legal capacity. The Customer must open a Customer Account at the time of his/her first order on the Website. For each order, the Customer must complete an order form containing certain mandatory fields so that his/her order of TREND.ME products can be taken into account.

The information provided to TREND.ME when opening its customer account and for each order must be complete, correct and up to date.

TREND.ME reserves the right not to process an order if the above criteria are not met.

3. PRODUCTS

Details about the products are shown on the website with each individual product. All products are marked with our TREND.ME loop please note that only with the marking the products are considered original.

4. ORDER PROCESS

In order for the customer to place an order, the following steps must be observed and carried out:

The customer browses the website and adds the product to his/her shopping cart, indicating the desired quantity. The customer checks the quantity, type and size of the products added to the shopping basket.

To delete an item from the shopping basket, the customer must click on "Delete".

By entering the desired number, the quantity can be changed. By refreshing the browser, the number is displayed changed.

The customer can continue or complete his/her order. In order to contractually validate the purchase, the customer must complete the order form with all personal information.

The customer must choose his/her payment method.

The responsibility for the details of the order, such as the total price of his order, the consideration of the price of the products, the VAT, the quantity and the delivery condition is entirely the responsibility of the customer.

The customer must have read, understood and accepted the General Terms and Conditions.

The customer makes the payment. The prices of the products on the website are stated in Swiss francs. These prices include VAT, but do not include customs duties and other taxes.

The responsibility for the correctness of the information transmitted to TREND.ME lies with the client and must be checked.

Depending on the country of destination, it is the customer's responsibility to pay customs duties directly to the carrier.

TREND.ME reserves the right to refuse any order placed by a client in the event of a dispute over payment or non-compliance with these terms and conditions.

TREND.ME is also entitled to refuse, cancel and terminate any order at any time for legitimate and legal reasons.

In these cases, TREND.ME will inform the customer by telephone or e-mail.

In the event that the products listed on the Website are no longer available or on sale at the time of the Customer's dispatch, TREND.ME must inform you immediately, within thirty working days from the date of your order, of the unavailability of the products ordered. If payment has already been sent to TREND.ME, TREND.ME will refund you the full amount for the unavailability.

The contract is legally concluded when TREND.ME receives the order and TREND.ME has verified the accuracy of the data transmitted with the order.

Once the order has been confirmed, an acknowledgement of receipt will be sent to the customer by e-mail. This contains a summary of the order information, as well as the essential characteristics of the product, its price, means of payment, delivery times and costs.

5. PAYMENT

The website offers payment by credit card, TWINT or Pay Pal. Other payment options are not available and will be declined. After the order is completed, TREND.ME confirms the successful payment by e-mail.

The prices indicated on the website are in Swiss francs. The prices include VAT which is applicable at the time of the order. Shipping costs are offered for purchases of one hundred Swiss francs or more. Purchases below this amount will be quoted by information before the order confirmation.

If the order value is less than CHF 49, a service fee of CHF 7 will be charged. This surcharge is visible to the customer as a small quantity surcharge for goods with a value of less than CHF 49.

TREND.ME may change the prices of all products and without notice. Changes are made for economic, legal or fiscal reasons. The invoicing of the products is visible and valid at the time of the order.

The products remain the property of TREND.ME until the full price has been received.

Payment is processed securely and confidentially by Pay Pal or Stripe.

For deliveries outside Switzerland, the import regulations and customs duties of the country concerned apply. The client shall bear customs duties and any taxes incurred himself/herself. The associated formalities are also the sole responsibility of the customer. The client is solely responsible for checking the import possibilities of the ordered products with regard to the rights of the territory of the country of delivery. TREND.ME accepts no responsibility in connection with delays in delivery due to customs controls or similar.

6. DELIVERY

The products will be delivered to the delivery address indicated on the order form. The package will be delivered according to the shipping method chosen by the customer and will be delivered to the recipient against signature of a delivery note (depending on the shipping method).

Currently, the delivery terms of 3-4 working days within Switzerland apply.

The products are currently only delivered to Switzerland. Please note that delivery to a hotel or PO Box address is not possible. TREND.ME undertakes to deliver and dispatch the orders within the stated delivery period of 3-4 working days.

6.1 What are the delivery times?

Within 3-4 working days. The day of the order is the first day. If this is on a Saturday or Sunday, the following Monday applies.

From the time the order is dispatched, the average delivery time is as follows: 3-4 working days within Switzerland by Swiss Post.

Please note that any change in the delivery address by the customer after the order has been entered may result in an extension of the delivery time.

In the event that TREND.ME is unable to deliver within the deadline indicated when the order was placed, the Client shall have the option of obtaining a cancellation of the order under the conditions set out in the Consumer Code. This must be submitted in writing by registered letter with acknowledgement of receipt, after instructing TREND.ME to make delivery within a reasonable period by registered letter with acknowledgement of receipt, without TREND.ME having complied with the obligation.

7. PRODUCT ACCEPTANCE

Upon receipt of the product, the customer must immediately check the condition of the packaging and the delivered product in the presence of the carrier.

If the packaging is damaged, torn or opened at the time of delivery, the customer must check the condition of the products contained therein. If the products are damaged, the customer must refuse the package and write a reservation on the delivery note. This must contain a note such as: Damage, defective item... and a legally valid signature of the customer.

The customer must confirm his/her reservation to the carrier by registered mail no later than three days (excluding public holidays) after receipt of the products and send a copy to shop@trendme.ch.

8. GUARANTEES

The customer benefits from a one-year guarantee. The date of order is applicable. The warranty does not cover normal wear and tear, jewellery damaged by improper handling, intentional alteration or unusual use.

8.1 Commercial warranty

The commercial guarantee is in addition to the legal guarantee mentioned below. TREND.ME is bound by this and will repair jewellery such as replacement of clasps, broken chains or loosened stones. The customer can claim the guarantee by sending it in by post, including the return form and the guarantee certificate. This guarantee is free of charge. For the shipping costs, a TREND.ME voucher can be requested in the shipping value. You can request this by e-mail. The guarantee is valid for one full year from the date the product is ordered.

The warranty is inconsistent if the following are disregarded: Improper use; damage due to improper handling, misuse or unusual use, intentional or accidental physical alteration, use for professional or commercial purposes; in the event of extraordinary maintenance or lack of maintenance and hygiene; in the event of natural wear and tear; tampering with the item of jewellery not carried out by the person authorised by TREND.ME and damage resulting from such tampering.

8.2 Legal guarantees

Unless it is a legal entity or a natural person acting for purposes relating to its commercial, industrial, craft or professional activity, the Client shall in any case benefit from the legal guarantees on the basis of which it may act. TREND.ME is therefore liable for defects in conformity and hidden defects under the conditions of

The seller in this case TREND.ME is obliged to deliver the contractually agreed goods and is liable for all defects existing at the time of delivery. He/she shall also be liable for defects arising from the packaging, assembly instructions or installation if these were charged to him/her by the contract or carried out under his/her responsibility.

To be in conformity with the contract, the goods must be in the best condition. The condition is determined from the time of purchase, based on a sample/model or similar goods.

A lack of conformity which occurs within 24 months of delivery of the goods shall be presumed to have existed at the time of delivery unless proved otherwise. For second-hand goods, this period is set at six months. The seller may rebut this presumption if it is inconsistent with the nature of the goods or the alleged lack of conformity.

In the event of a lack of conformity, the buyer chooses between repair or replacement of the goods. However, the seller may not proceed at the buyer's option if this choice entails an expense that is clearly disproportionate to the other method, taking into account the value of the goods or the significance of the defect.

If it is impossible to repair or replace the goods, the buyer can return the goods and have the price returned or keep the goods and have part of the price returned. In the second option, this is only done via vouchers which are redeemable on the website.

The same provision is available to the buyer: If the requested, proposed or agreed solution cannot be implemented within 30 working days of the buyer's complaint However, the sale cannot be cancelled if the lack of conformity is minor.

9. RIGHT OF WITHDRAWAL OF THE CUSTOMER

Before executing the order, the customer can contact us by e-mail and withdraw from his/her purchase.

As soon as the order has been placed, Swiss law applies. This does not provide for a return period or any other right of return for online commerce after the order has been sent. However, the seller is not subject to any legal obligation in this area.

10. EFFECT OF THE CONTRACT

The contract becomes fully effective upon conclusion and cannot be terminated unilaterally by either party.

11. INTELLECTUAL PROPERTY

TREND.ME's products and the image, concept, packaging, product names, text, illustrations and photo compilations are the exclusive property of TREND.ME. The associated Intellectual Property throughout the entire term shall be deemed to be the property of TREND.ME worldwide.

Each product is marked with the TREND.ME loop and clearly conveys the brand's quality and affiliation. If jewellery of the same shape is in circulation without the loop, it may be counterfeit.

The Client waives any reproduction or use of the product models, image, concept, packaging, product names, texts, illustrations and photo compositions, icons, trade secrets, techniques or know-how used by TREND.ME. This provision applies whether or not a trademark, copyright or design is protected.

Consequently, any act of an item not authorised by TREND.ME and without the imprint of the loop will be a counterfeit which may be prosecuted.

13. DISPUTE RESOLUTION

In the event of a dispute, the Client must first contact TREND.ME in writing (with a legally valid signature and full name). This will be followed by e-mail at shop@trendme.ch and must clearly describe what the cause is.

14. APPLICABLE LAW AND COMPETENT JURISDICTION

The GTC are subject to Swiss law
